The Demise of the 28-Clause Peace Proposal for Ukraine: How Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the diplomatic emergency caused by the presentation of a new 28-point plan for achieving ceasefire appeared – briefly – to have been defused. A senior US official spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Moscow made its countermove: an extensive attack of rocket attacks on Kyiv.

The Cycle of Peace Talks and Military Action

The sequence of conflicting incidents captured the grim essence of the current period. By day, political struggles are fought: hopeful statements are delivered from multiple capitals. Immense energy is devoted on restraining specific proposals. By night, Moscow forcefully demonstrates the world that, for them, military action persists as the key method for achieving "settlement".

After-Dark Attacks

As military strikes progressed into the early hours of Tuesday, the immediate reality of Ukraine's vulnerability was exposed. Ukraine is able to track projectile deployments from Russian territory, a capability enabled by timely intelligence. From observation points, military aircraft that had been deployed to intercept incoming aerial threats roared overhead – modern combat jets provided to Ukraine by NATO members.

Moments later, Kyiv's missile defense thundered: multiple launches targeted at a Russian ballistic missile. This was a sophisticated defense system at work, probably provided by Western nations. Every launch jolts you unexpectedly, shaking the windows. The brief panic quickly gives way to sober acceptance: possibly the approaching threat won't strike its target this time, sparing the city from catastrophe and further power outages.

Ongoing Risks

Not long after, a heavy machine gun fired at a unmanned aircraft close by, part of a rapid response unit – probably allied-provided weaponry. Regrettably, the projectiles didn't strike the opposing UAV – it continued its flight toward its objective.

Intermittently, this continued until dawn. Kyiv greeted the morning news: several casualties, devastation and heating outages in numerous residences as a result of the night's assault. As customarily, everyone still continued their routines – enduring hostilities. But those entire period encapsulated Ukraine's critical military reliance on international aid – a need that European nations are clearly incapable to substitute in the near term.

Failed Diplomacy

The detailed framework from US administration sparked intense emotion, controversy and profound anxiety – and temporarily diverted attention from Ukraine's most significant graft case in years. Yet, we have seen this script before, after earlier high-level meetings and bilateral conferences.

Every new initiative from Washington unfolds according to the same pattern: a political offensive against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They stabilise the situation but never actually win the battle. This cycle will, undoubtedly, continue.

Tactical Assessments

It is tempting to accuse specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the whole story. Washington functions according to a premise understood by international relations experts: you cannot achieve through diplomacy what you have failed to defend militarily. The US administration presumes that it is impossible to compel Moscow to abandon the land that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, US leadership does nothing to prevent Kremlin actions, through diplomacy or military means, from assuming that the status quo will not shift further in its favour in the near future.

Opposing Positions

Therefore, the Kremlin is convinced that duration works to their advantage – that Ukraine and its partners are nearing depletion. Their incentive to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to achieve ceasefire, but they will persist as long as Russia's government remains highly assured in the result.

On the contrary, Kyiv believes that Ukraine can still hold out, slowly losing civilians and areas but preventing a complete military breakdown until circumstances change in its favour.

Present Conditions

Factually, there are no genuine requirements for a ceasefire. Now, personal considerations are becoming relevant: personal goals to mediate resolution and secure international recognition, and Kyiv's double obstacles – on one hand, not to alienate a key ally, and on the other, to unite the population around the country's interests against any initiative Kyiv finds unacceptable, so that their priority does not switch to homefront challenges. And although their objective will now be much harder after latest incidents, it remains very improbable that this will modify their basic position.

These opposing factors are driving the talks.

Conclusion and Outlook

It took a just a single week to eliminate the suggested clauses of the latest plan. Forceful and unpredictable management of the matter by US administration, resistance by Ukraine and the rest of Europe, along with soothing efforts of diplomats, and finally, recent disclosures, all achieved their purpose.

While new plans based on established approaches are approaching, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are rooted in Kremlin requirements and show certain reluctance to alter the situation, if they remain united and strengthen their defence capabilities at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the foreseeable future, largely rely on continued Western support.
